New Mexico Makes Donor Designation on Liscense Legally Binding

 

A new law has taken effect in New Mexico allowing doctors to remove organs from a dead person for transplantation based solely on an organ-donor designation on that person's driver's license.

The law makes the organ-donor designation on the driver's license a legally binding agreement, removing the requirement that consent for donation be obtained from the accident victim's next of kin.

The new law does not apply retroactively to anyone who previously obtained their driver's license.

Laurie Garretson, executive director of New Mexico Donor Services in Albuquerque, said those who want to be donors must sign another consent form before a witness and obtain a sticker to be attached to their driver's license.
